Terms and  Health Warranty
"BREEDER" guarantee's the puppy to be healthy, socialized and free of contagious diseases at time of transfer of said puppy to "BUYER".  The "BREEDER" will provide up to
date health record information to "BUYER" at time of transfer of puppy verifying all vaccinations and de-worming is up to date for appropriate age.

"BREEDER" is not held responsible for stress related outbreaks (including diarrhea) caused by transfer of said puppy to a new environment.  "BREEDER" will make themselves
available to "BUYER" for questions, concerns, and to assist with advice on how to maintain a smooth and as stress free as possible transition.

BREEDER will replace the puppy from the next available litter or give a full refund if this puppy dies from a contagious disease within 3 days of leaving the home of the
BREEDER.  BREEDER strongly advises that the BUYER take the puppy to their own vet for a health check-up within 72 hours of picking up puppy, after which the above health
warranty expires. If puppy is found to be ill during the first 72 hours, BUYER may return the puppy for a full refund.  
BREEDER guarantees this puppy for 3 years from the time of purchase against hip and eye defects proven to be genetic in nature, and in the event that hip or eye defects occur,
and are to the degree of debilitating, BUYER must provide written certification from the Orthopedic Foundation for Animals (OFA) as evidence (hips) and or from a certified
Ophthalmologist(eyes).  If it is confirmed by the OFA that the defects are of genetic origin, then the BUYER may return the dog and have a replacement puppy from the next
available litter or opt to keep the dog and if treatment is an option, then the BREEDER will contribute funds up to the cost of the treatment, but not exceeding $1000.00.  Any cost
over that will be covered by the BUYER should they opt to keep and treat the dog.  At no time will the BREEDER be responsible or agree to medical treatment without written
agreement/consent to the BUYER, from the BREEDER, to cover any expenses.  In the case of a genetic eye defect, written proof of the genetic eye defect must be provided by a
certified Ophthalmologist.
BREEDER does not guarantee dog against diseases or medical conditions such as epilepsy, diabetes, allergies, parvo, distemper, parasites, etc., as they cannot be proven to be
genetic in nature and can be caused by external or environmental factors.
BREEDER is not responsible in any way for accidental death or injury to dog once it leaves the BREEDER’s premises.
BREEDER agrees to provide verbal or written advice and support to BUYER for the life of the dog and agrees to take back the dog if at any time the BUYER can no longer keep
it, for as long as the BREEDER is breeding dogs.

Terms of Agreement:
“BUYER” agrees that this health guarantee will become null and void if puppy is spayed or neutered before the age of 6 months.
“BUYER” agrees that this health guarantee (in regards to hips) will become null and void if puppy is allowed to participate in jumping events such as agility, flyball or disc dog
before the age of 6 months.
"BUYER" certifies, by signing this agreement, that said puppy/dog will have adequate exercise, shelter, fresh water, all necessary health care from a licensed veterinarian, and
nutritious food that does not contain corn or artificial color.
“BUYER”  agrees to provide proper socialization and training which includes, but is not limited to, attending one session of puppy socialization/obedience classes before the
puppy reaches 8 months of age. Failure to attend may lead to significant behavioral issues which may negatively impact dog for life. It is highly recommended to schedule puppy
classes as soon as possible after bringing home puppy.

"BUYER" agrees that he/she will not sell or give said puppy/dog to a pet store, pound, animal shelter, guard dog business, or research facility.
“BUYER” agrees to never leave the dog tied or chained outside and left alone for any period of time.
“BUYER” agrees to never leave the dog inside a hot car unattended in which it could endanger the dog’s life.
“BUYER” agrees to keep in contact with BREEDER by providing one photo of dog at least around the age of one year. This, can be sent by email.  BUYER will also notify
BREEDER of any change of address or if there are any major health issues or temperament concerns with dog.  
"BUYER" agrees, that if ever he/she no longer wants, or can no longer take care of the puppy/dog at any time in said puppy/dog’s life, he/she will give “BREEDER” first
opportunity to find said puppy/dog a suitable home at no cost to “BREEDER.”  In such a case, BUYER must also transfer any registration papers they may have back to the
BREEDER’s name.  
"BREEDER" does not guarantee a puppy to stay within size standard. (i.e., a Toy sized Aussie with a size limit of 14" could mature over 14" then classifying it as a Miniature sized
Aussie).
“BUYER” agrees to have dog spayed or neutered by 18 months of age, early spay/neuter is not recommended due to growth plates. (Females should be at least 8 months old).  
Prefer males to be a year old before neutering.  A copy of the spay/neuter certificate must be sent to BREEDER for recording.

"BUYER" has read and understands the foregoing and agrees that all parts of this contract are a binding agreement with the "BREEDER.”
This contract is being put in place for the welfare of the dog and the protection of both the BREEDER and BUYER in order to clearly outline the terms of agreement between both
parties.  This agreement has been mutually stipulated to have been entered into in the Township of Cavan Monaghan, in the County of Peterborough, Province of Ontario,
regardless of where this agreement was signed. Both parties agree that the proper venue for any legal action taken to enforce the terms and conditions of this agreement shall
take place in county of the BREEDER’s residence and that this agreement shall be interpreted in accordance with the laws of Ontario.  In the event that legal action is taken to
enforce the terms of this agreement, the prevailing party shall be entitled to an award of attorney’s fees and costs.  This contract is binding in the Province of Ontario and is non-
transferable unless agreed upon by both parties.

This is a SAMPLE Co-OWN contract, and many times we can negotiate the terms involved. I'm a pretty flexible with some of the terms of this agreement.  If you have questions,
please don't hesitate to ask.  

As well as the attached pet contract, the Buyer agrees to the following:

1.        Dog must remain unaltered, intact and available for stud use for the agreed amount of stud services, or the agreed amount of years (see below in blue.) or until
2.        Breeder prefers that the dog is altered after the contract has been fulfilled.  Cost of altering is the responsibility of the Buyer.  Buyer must provide proof of neuter to the
Breeder in order to obtain transfer of registered ownership papers.   
3.        If Buyer decides to keep dog intact, then the dog remains a co-owned dog.  The buyer may not allow breeding of dog to any other dog without written authorization from
breeder.  If breeder and buyer agree to any stud service after the agreed upon contract, the stud fee generated will be split 50/50 between the Breeder and the Buyer/co-owner.
4.        Dog must be kept in good health, not become overweight while under contract, and groomed on a regular basis enough to keep the dog healthy.  Generally, grooming
consists of brushing the coat monthly, and keeping nails trimmed.
5.        Dog must not be allowed to breed to any dog other than a dog(bitch) the Breeder has chosen.
6.        Dog must be properly confined during times he is unattended or under control as to not allow him to reproduce accidentally.  A fenced back yard is preferred.  You may
not offer the dog to anyone else to use as a stud unless approved by breeder.
7.        Dog must be available to Breeder for breeding purposes.  Advance notice will be provided.  Dog will stay with Breeder or owner of dog(bitch) to be bred, for a minimum of
1 day to a maximum of 10 days for each servicing.  Note:  The dog may need to travel out of town for stud service.  Average being 6 days.  For stud dogs in same city, dog will
be returned each day.  Breeder will screen every bitch owner to ensure they are a responsible breeder and that the stud dog’s accommodation and care are satisfactory and the
bitch is healthy.
8.        Breeder is responsible for providing quality care to the stud dog while in her care and ensuring the dog receives quality care while in possession of a bitch owner.
9.        Dog is registered in Breeders name as the registered owner of the dog until the Co-Own part of this contract is fulfilled.  This contract is fulfilled when dog has been
neutered.  Breeder will then transfer ownership of the dog to Buyer and send Buyer the registration papers.
10.        Approximately around 12 to 36 months old, the dog may have his eyes and hips tested to be sure he is suitable for breeding purposes.  It is the choice of the Breeder
whether to allow stud service before hip testing.  Breeder will cover the cost of hip and eye testing.  Also, any other test required in order for this dog to be used as a stud dog,
will be the responsibility of the Breeder.  All other Vet costs including regular or emergency care, vaccinations, medications, and care, are the responsibility of the Buyer for the
life of the dog.
11.        This dog is your pet/companion.  He will live with you and be your dog for his lifetime.  All costs of food, training, grooming, toys, boarding fees, etc., are the responsibility
of the Buyer.
12.        Buyer agrees to allow Breeder to show dog in conformation shows until he receives the title of Champion (or agrees to have dog titled in Agility, Flyball, Disc Dog or
some other form of titling.)  Show entry fees will be responsibility of the Breeder; unless Buyer wishes to show the dog themselves, then the cost of the entry fees is the Buyers.  
Breeder reserves the right to decide not to show or title the dog in any way.
13.        No stud fee will be ever be paid to Buyer for studding to one of the Breeder’s dogs. (Follow Me Aussies dogs or co-owned dogs.) Note: The more Best of Breed, or
Champion wins or Titles a dog receives, the more attractive he will be to other breeders, and therefore, more breeders will want to use him as a stud.  If the Buyer wishes to keep
the dog intact after our period of agreement, the breeder will pay the buyer 50% of any stud fee received for any stud services served beyond our agreement.  Each stud still
needs to be approved by Breeder.
14.        Buyer agrees to either provide photos of dog (preferably “stacked”) at regular intervals until this contract is fulfilled, one photo at 7-9 months of age, one at one year of
age, and one at 2 years of age, or, allow Breeder access to dog at these regular intervals for photographing the dog.
15.        Buyer agrees to the best of their ability to socialize the dog to people of all ages and to other animals, especially other dogs.
16.        No refund of purchase price will be given for a co-owned dog.

over, and fulfilled, meaning the dog has sired at least one litter of 4 or more puppies, Breeder will pay up to $250 toward neutering if neutered.  If dog stays intact, then dog is
considered still under contract.  Any stud service provided to bitches not owned or co-owned or leased by Breeder will result in a payment to the Buyer of 50% of the stud
revenue. For as long as dog is intact, dog must be made available to Breeder for use with her owned, co-owned or leased females.

$______purchase price for puppy in exchange for 4 years of stud availablility. (From date of  signed contract) No sharing of stud fee income until after 4 years.  Once contract is
over, and fulfilled, meaning the dog has sired at least one litter of 4 or more puppies, Breeder will pay up to $250 toward neutering if neutered.  If dog stays intact, then dog is
considered still under contract.  Any stud service provided to bitches not owned or co-owned or leased by Breeder will result in a payment to the Buyer of 50% of the stud
revenue. For as long as dog is intact, dog must be made available to Breeder for use with her owned, co-owned or leased females.

over and fulfilled, meaning the dog has sired at least one litter of 4 or more puppies, Breeder will pay up to $250 toward neutering if neutered.  If dog stays intact, then dog is
considered still under contract.  Any stud service provided to bitches not owned or co-owned or leased by Breeder will result in a payment to the Buyer of 50% of the stud
revenue. For as long as dog is intact, dog must be made available to Breeder for use with her owned, co-owned or leased females.
